Se ordenó remitir el expediente a la Sala de Familia del Tribunal Superior de Ibagué para lo de su competencia y comunicar lo aquí decidido a los Juzgados Segundo Civil del Circuito del Espinal y Primero Civil Municipal del Espinal.
Lo anterior, porque se aplicó el Art. 1º del Decreto 1382 del 12 de julio de 2000 mediante la excepción de inconstitucionalidad, por ser una norma manifiestamente contraria a la Carta Política.
